What is Burglary and What are the Potential Penalties for a Burglary Conviction?
Massachusetts defines burglary as the breaking and entering of a dwelling in the nighttime, with the intent to commit a felony. The full statute can be found here.
In order for a jury to find a defendant guilty of burglary, the Commonwealth must prove each of the following elements beyond a reasonable doubt:
- That the defendant broke into a dwelling belonging to another person;
- That the defendant entered the dwelling;
- That the defendant did so with the intent to commit a felony; and
- That this event took place at night.
The maximum penalty for a burglary conviction is twenty 20 years in a state prison, and a mandatory minimum of five years for a second and subsequent offense, so long as the accused did not possess a dangerous weapon and did not assault anyone in the process.
